We have noticed that more and more copies of our candles are appearing on the European market. A large number of illegally manufactured candles (especially cylinder candles) came to Germany from Poland.

 

We would like to point out to our customers that Elem Candle Andrzej Madrzyk and Filip Madrzyk GbR has the sole rights of production and sale of these candles in Germany, Poland and almost all other EU countries. Since we do not currently have intensive business relations with any wholesalers, the verified purchase of these candles is only possible through our company. Any sales and offers made by individual wholesalers at non-market prices are not permitted and are therefore illegal.

 

For some time, we have been working closely with the police and with law enforcement agencies; and we are also taking preventative measures against these black market dealings. Many retailers do not know that the candles sold by us are subject to WIPO design protection in Geneva (registration number DM/054915) and that the import and sale of copies is actionable under civil and criminal law. Retailers are also often not aware that injunctive relief under civil law holds even if the supplier does not know that the goods are counterfeit copies.

All candles sold by us leave our factory with an invisible security feature. This feature allows all candles of questionable origin to be checked immediately. More and more of such checks are being carried out. These measures are in particular also designed to protect our honest customers. Counterfeit goods sold at dumping prices also damage your business. If you suspect that you are being offered copies, please let us know as soon as possible. We will then check the legitimacy of these goods.

 

We believe that we owe it to our customers to keep illegal offers off the market and thus protect your business.
